Terms of Service

DRAFT — These terms will be finalised before paid subscriptions go live.

Last updated: March 2026

A note from us: Inkborne is built by a small team in Australia and is still in its early stages. Some of these terms will firm up as we approach full launch (expected by end of 2026). We believe in being transparent about where we are — if something here affects you, please reach out and we'll work it out fairly.
About This Service

Inkborne is owned and operated in Australia. By using this service you agree to these terms, which are governed by the laws of Australia. Any disputes will be resolved under Australian law and in Australian courts.

We comply with the Australian Consumer Law (ACL) and the Australian Privacy Act 1988. Your statutory consumer rights under Australian law are not affected by anything in these terms.

Account Terms

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials. One account per person — shared or automated accounts are not permitted.

You must be at least 13 years old to use Inkborne. If you are under 18, you should have a parent or guardian's consent.

Billing & Credits

Paid subscriptions are billed monthly via Stripe. Your subscription includes a monthly credit allowance for AI generation tasks (images, story writing, rewrites). Unused monthly credits do not roll over to the next billing cycle.

Bonus credits (from credit packs or promotions) do not expire and persist until used.

You may cancel your subscription at any time. When you cancel, your access continues until the end of the current billing period.

Credit packs are one-time purchases. Because credits are available for immediate use, credit packs are generally non-refundable. If you haven't used any credits from a pack, contact us within 7 days for a refund.

Pricing note: We are a small team and our costs depend on upstream AI provider pricing, which can change. We will give at least 14 days' notice before any price increases to existing subscribers. We aim to keep pricing fair and proportional to what the service actually costs us to run.

Failed Generations & Credit Refunds

If an AI generation task fails due to a service error (not a user input issue), the credits charged for that task are automatically refunded to your account. You do not need to request this — it happens within seconds of the failure.

If you believe you were incorrectly charged or experienced a billing issue, contact us and we will investigate promptly.

Subscription refunds are handled on a case-by-case basis. If the service isn't working as described, let us know within 7 days and we'll sort it out. Nothing in this section limits your rights under the Australian Consumer Law.

Content Ownership

You retain ownership of your original prompts, creative direction, story concepts, and any text you write. The AI-generated content (text and images) produced by the platform is yours to use, including for commercial purposes, subject to the terms of the underlying AI model providers (Anthropic, Google).

You are responsible for reviewing AI-generated content before publication. AI output may contain errors, biases, or unintended content.

We do not claim ownership of your content. We do not use your content to train AI models. Your projects are private by default and only visible to people you explicitly share them with.

Acceptable Use

You may not use Inkborne to:

  • Generate content that is illegal under Australian law, or that promotes violence, hate, or exploitation
  • Produce content that infringes on the intellectual property rights of others
  • Attempt to bypass credit limits, abuse free tiers, or exploit the billing system
  • Interfere with the service or other users' experience

We reserve the right to suspend or terminate accounts that violate these terms. Where possible, we'll warn you first.

Service Availability

We aim to keep Inkborne available and reliable, but we're a small operation. Downtime happens — for maintenance, upgrades, or the occasional unexpected issue. We do not guarantee any specific uptime percentage.

If extended downtime affects your subscription period, we'll extend your billing cycle or issue credit to compensate.

Changes to These Terms

We may update these terms as the service evolves. For material changes (especially anything affecting pricing or your rights), we'll notify you by email at least 14 days in advance. Continued use after changes take effect constitutes acceptance.

We expect these terms to become more detailed as we approach full launch by end of 2026. The spirit will remain the same: be fair, be transparent, and treat creators well.

Limitation of Liability

To the maximum extent permitted by Australian law, Inkborne is provided "as is" without warranties of any kind. We are not liable for any loss of data, content, revenue, or creative work arising from use of the service, including but not limited to AI generation failures, data loss, or service interruptions.

Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded by law.

International Users Under Review

Inkborne is currently hosted in and operated from Australia. We welcome users from anywhere, but please be aware:

  • Your data is stored on servers located in Australia and the United States (via cloud providers)
  • Payments are processed by Stripe under their applicable regional terms
  • We are working on formalising compliance with international regulations including GDPR (EU/UK) and CCPA (California) ahead of full launch

If you have questions about how these terms apply in your jurisdiction, please contact us.
